The complexity in relation to the existing evidentiary infrastructure; 2. The release of the security detainee to Gaza and its implications on the evidentiary level, in addition to the existing complexity; 3. Defense from justice – the conduct of senior officials in the Military Advocate General’s Corps and the law enforcement system in the IDF in this affair, and its unusual and unprecedented circumstances; 4. Procedural difficulty regarding the transfer of relevant investigation materials from the investigation file being conducted by the Israel Police, in a manner that harms the defendants’ right to a fair trial. The accumulation of all these unusual circumstances, and their impact on the basic and fundamental right to a fair trial, necessitates, in the view of the Military Advocate General, the cancellation of the indictment. The role of the Military Advocate General’s Corps is to enable the IDF to fulfill its missions, and alongside that, to enforce the law against those who act contrary to the law. The women and men of the Military Advocate General’s Corps are at the heart of the IDF’s operational and legal activity, and the unit’s officers have been and continue to be engaged in a wide range of missions even during these fighting days, and will continue to do so with dedication, objectivity, and professionalism. The Chief of Staff has been updated on the details of the decision. The Chief of Staff strengthens, appreciates, and backs the Military Advocate General and expressed his appreciation for the process that has been carried out since his entry into office. In light of the severe professional failure that was discovered, the Chief of Staff instructed to draw lessons and take all necessary steps to prevent similar cases in the future. The Chief of Staff reiterated that the professional independence of the Military Advocate General’s Corps is a fundamental principle in the IDF, and he strengthens the hands of those serving in the Military Advocate General’s Corps, who operate professionally, with dedication, and tirelessly to enable the IDF to realize its goals and carry out its missions, including during these fighting days.
