According to the verdict, after the deceased was lying on the ground, Kresh hit him with a plank many times on all parts of his body until his death. The incident occurred after Kresh became angry at the deceased following a dispute that arose over the theft of a converter from a vehicle he was working on at the garage.
The verdict determined that Kresh was aware that the deceased was in a serious health condition and permanently needed an oxygen balloon for his breathing, and that despite the deceased’s condition, and at a stage where it was already apparent that he was having difficulty breathing and bleeding, Kresh did not call for medical assistance and did not act to help him, leaving him at the scene.
As part of the sentencing arguments, the Jerusalem District Prosecutor’s Office argued that this was a severe and fatal act of violence against an elderly and ill person who was left helpless on the ground, and that Kresh’s conduct both during and after the attack, when he did not call for help despite the deceased’s condition, reflects extreme indifference to human life and justifies a severe and deterrent punishment of 22 years of actual imprisonment, along with compensation to the deceased’s family.
The court sentenced him to 19 years in prison, a suspended sentence, and compensation to the deceased’s family. The court determined that “from the Supreme Court‘s rulings, there has recently been a trend of harsher sentencing for severe violent offenses. This is especially true regarding the offense of murder with indifference…”.
